Calculation of the Validity Period

Starting point: The validity period is calculated from the trademark filing date and lasts for 10 years.

Standard period: A renewal application may be filed up to 12 months before the expiry date.

Grace period: If the standard period is missed, renewal may still be filed within 6 months after expiry, subject to escalating late fees:
- First 2 months: Additional NZD 100 per trademark.
- Following 4 months: Additional NZD 200 per trademark.

Risk warning: During the grace period, trademark protection is suspended, and third parties may seek cancellation or file identical or similar marks.

Consequences of Missing the Grace Period

Loss of rights: After the grace period expires, the trademark is removed from the register and cannot be restored, except under very limited force majeure circumstances.

Restoration fees may reach NZD 1,020 per trademark, with a very low success rate.

Base renewal fee (first class): NZD 370.
Additional class fee: NZD 150 per additional class.
Late fee (first 2 months of grace period): NZD 100.
