The United States Patent and Trademark Office (USPTO) Artificial Intelligence (AI) Strategy aims to promote responsible AI development and enhance U.S. leadership in innovation and global competitiveness. This strategy highlights AI's significance in optimizing patent and trademark examination processes, driving scientific research, and fostering economic growth, while also addressing potential risks such as privacy violations and intellectual property (IP) infringements.
The strategy focuses on five key areas:
Advancing Inclusive AI Innovation and Creativity
The USPTO is committed to developing IP policies that meet the needs of innovation, covering AI-related issues in patents, trademarks, copyrights, and more. For instance, in response to the rapid development of generative AI, the USPTO has introduced new guidelines on inventorship and patent eligibility to ensure AI innovation advances within a legal framework.
Building Best-in-Class AI Capabilities
The USPTO is heavily investing in computational infrastructure and data resources to enhance the application of AI tools. AI technology has already been utilized to improve patent classification and examination processes, while virtual assistants support small businesses and independent innovators in engaging with the IP system.
Promoting the Responsible Use of AI
Following federal guidelines, such as the AI Risk Management Framework and the Blueprint for an AI Bill of Rights, the USPTO emphasizes transparency, fairness, and safety in AI applications. Through risk mitigation and open communication, the USPTO strives to ensure that AI tools are trustworthy and ethically aligned.
Developing AI Expertise Within the Workforce
