Clarification on Trademark Renewal and Re-registration Procedures in Libya

Trademark Office in Libya has issued Circular No. 2 of 2025, dated June 1, 2025, which clarifies the distinction between the expiration of a trademark’s protection period and the official cancellation date.

 

Due to the high government fees associated with trademark renewals in Libya, many trademark owners have chosen to allow their marks to lapse and then re-register them after the protection period and its legal grace period have expired. In response to this trend, the Trademark Office has established clear guidelines regarding the re-registration process.

 

According to the circular, if a trademark is not renewed, the owner may only re-register the same trademark after a formal cancellation decision is issued by the Trademark Office and published in the Official Gazette.

 

Following this publication, the trademark owner will have a three-year window from the date of publication to proceed with re-registration.
