Marcel Pemsel examined the General Court's decision to annul the revocation of Ferrari’s ‘TESTAROSSA’ trademark, finding that the sale of second-hand cars by authorized dealers constitutes genuine use and that use of the mark for directly connected services, parts, and accessories is also sufficient to demonstrate genuine use, applying and expanding upon the CJEU’s prior Ferrari judgment.
