With respect to pending trademark applications
The notice calls on Applicants to submit any pending documents if their applications have not yet been published in the Industrial Property Bulletin, and to pay the prescribed fee and collect the registration certificate if all formalities have been completed, all within 90 days from the date of publication of the notice. The DOI shall accept the necessary documents for such pending applications, provided they are submitted on or before November 16, 2025. It is therefore strongly advised to ensure that any outstanding documentation is filed within this specified deadline.
Please also note that failure to submit the required documents by the stated deadline will result in suo moto cancellation of trademark applications that have been pending for a period exceeding seven (7) years. This action will be taken unilaterally by the DOI, and such applications will be deemed abandoned and removed from the official records, without further notice.
With respect to registered trademarks
In Nepal, a trademark which has not been used for a period of one year from the date of registration may become vulnerable to non-use cancellation upon action by a third party.
In accordance with the same, for trademarks registered before August 19, 2025, the notice indicates that evidence of use should be submitted within 60 days of the notice date. However, as per the understanding with the DOI, submission within this period is not strictly required. However, in order to minimize any potential risk of cancellation on the request of third party or future objections or notices of Trademarks Registry, on the grounds of non-use, it is strongly recommended to submit proof of use as per your convenience, at the earliest possible.
For trademarks registered after August 19, 2025, it is advisable to submit evidence of use at the earliest opportunity following registration. This is to prevent the possibility of cancellation based on non-use, particularly during the post-registration period. Under the trademark law of Nepal, evidence of use must be submitted within 12 months from the date of issuance of the registration certificate. However, as Nepal is a member of the Paris Convention for the Protection of Industrial Property, there is an alternative provision whereby, for foreign trademark Applicants, the evidence of use may also be submitted within three years from the date of registration.
