Calculation of the Validity Period
Starting point: The validity period is calculated from the trademark filing date and lasts for 10 years.
Renewal mechanism: Each renewal extends the protection period by a further 10 years, with no limit on the number of renewals.
Legal basis: Pursuant to Sections 65–67 of the New Zealand Trade Marks Act 2002, renewal is the only lawful means by which a trademark owner may maintain exclusive rights.
Renewal Time Windows
Standard period: A renewal application may be filed up to 12 months before the expiry date.
