1. Scope of Trademark Changes: What Can Be Updated?
Hong Kong trademark changes apply to “informational items” recorded in the register, including:
- Change of trademark owner’s name (e.g., company renaming; or personal identity document updates);
- Change of address (corporate relocation or personal residential address change);
- Assignment (transfer of ownership);
- Change of agency recordal (if a new trademark agency is pointed, such change should be recorded);
- Change of address for service
The address provided for the service of documents related to a trademark is crucial for direct communication between the party, the Registrar of Intellectual Property, and the other party. If there are any changes to the information such as the address for service of documents, name, or telephone number, an application for change must be submitted promptly. Furthermore, the address for service of documents must be a residential or business address in Hong Kong; P.O. boxes or virtual office addresses are not acceptable.
Important note:
- Any modification to the trademark itself (logo, wording, colors, combination) requires a new trademark application, not a change recordal.
- If the identity of the trademark owner changes (for example, due to a merger or division of the enterprise), this constitutes a trademark assignment/transfer. In such cases, an application for assignment/transfer must be submitted, rather than an application for change.
2. Trademark Validity and the Effect of Changes
A Hong Kong trademark is valid for 10 years from the registration date.
Renewal periods:
- Renewal may be filed before expiry, and the term of each renewal is 10 years;
- A 6‑month grace period is available after expiry (late fee applies).
Key rule:
- Changes only update register information and do not affect the validity period or renewal schedule.
3. When to File a Change & Official Fees
Applications for changes in Hong Kong can be submitted at any time, and it is not necessary to change all trademarks under the same registrant at once; applicants may apply for changes multiple times and at any time. In addition, when applying for a change, the applicant may include multiple trademarks that require changes within the same application.
There is no official fee for change applications in Hong Kong; only agency fees will be incurred.
4. Required Documents and Filing Procedure
To apply for a change to a Hong Kong trademark, you only need to submit one change application form, namely IPD Form T5. There is no need to provide supporting documents such as the company name change certificate, address change certificate, or other qualification documents. If the change application is filed through an agent, a power of attorney is also not required, making the process very convenient.
The change application can be submitted online, and the examination is usually completed within 4-6 weeks.
It is important to note that when submitting a change application for a Hong Kong trademark, both the agent and the address for service will be changed at the same time. Therefore, if the trademark owner does not wish to change the agent or the address for service, they should first complete the change of name or address, and then submit another change application to revert the agent and address for service to the previous information.
