Notice of the China National Intellectual Property Administration on Implementing the Measures for the Administration of Prioritized Examination of Patents

The newly revised Measures for the Administration of Prioritized Examination of Patents (Order No. 85 of the China National Intellectual Property Administration, hereinafter the new Measures) will come into force on 1 September 2026, and the Measures for the Administration of Prioritized Examination of Patents issued in 2017 (hereinafter the former Measures) will be repealed at the same time. In order to ensure a smooth transition between the former and the new rules and the orderly continuation of prioritized examination business, the relevant matters are hereby notified as follows:

1. Requests for prioritized examination of patents filed on or after 1 September 2026 shall be handled in accordance with the relevant provisions of the new Measures; those already filed before 1 September 2026 shall continue to be handled in accordance with the provisions of the former Measures.

2. For requests for prioritized examination filed on or after 1 September 2026 by parties to reexamination or invalidation cases, the relevant business shall all be handled online through the “Patent Affairs Services” module of the “Patent Business Handling System” of the China National Intellectual Property Administration. For the specific handling procedure, see Annex 1. The “Reexamination and Invalidation” module of the former “Patent Business Handling System” will no longer accept prioritized examination business for reexamination or invalidation cases.

3. Requests for prioritized examination of patents filed on or after 1 September 2026 shall use the newly revised Request for Prioritized Examination of a Patent form; the old version of the form shall cease to be used at the same time. For the form template, see Annex 2. This revision of the form does not involve any adjustment to the client software or to the data standards and specifications for electronic filing.
