To the intellectual property offices and data administration departments of all provinces, autonomous regions, municipalities directly under the Central Government and the Xinjiang Production and Construction Corps:
The various categories of business data generated by intellectual property administration departments in the course of performing their duties are important national public data resources. In order to thoroughly implement the decisions and arrangements of the CPC Central Committee and the State Council on better leveraging the role of data as a factor of production and accelerating the development and utilization of public data resources, and to further strengthen the development and utilization of intellectual property data resources, the following opinions are hereby put forward.
I. General requirements
Guided by Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era, we shall thoroughly implement the spirit of the 20th CPC National Congress and the successive plenary sessions of the 20th Central Committee, fully, accurately and comprehensively apply the new development philosophy, coordinate development and security, take the promotion of compliant and efficient circulation and use of intellectual property data as the main line and the release of the value of intellectual property data as a factor of production as the objective, and — by improving institutional rules, strengthening efficient supply, enriching application scenarios, raising the level of development and utilization, and reinforcing data security — form a working structure with clear rights and responsibilities, inter-departmental coordination and top-down linkage, so as to provide strong support for building China into an intellectual property powerhouse and for the high-quality development of the digital economy.
II. Consolidating the foundation of intellectual property data resources
(1) Improving the management system for intellectual property data resources. Improve the full-life-cycle management system for intellectual property data, and clarify the requirements for each stage, including data collection and aggregation, storage and processing, and sharing and opening. Strengthen classified and tiered management of data, and clarify the boundaries of use and the security protection requirements for each category of data. Carry out data security risk assessments. Compile a national catalogue of intellectual property data resources and establish a “single ledger” for intellectual property data resources. Local authorities shall establish and improve working systems for the development, utilization and security safeguarding of intellectual property data resources, apply list-based management to intellectual property data resources within their jurisdictions, and fully incorporate them into the local catalogue systems for public data resources.
(2) Improving the standards system for intellectual property data resources. Study and formulate standards for basic intellectual property data, data governance, development and utilization, and data security, and promote the alignment of intellectual property data standards with relevant industry standards and technical specifications. Local authorities shall actively carry out standards development and organize industry associations, service providers and key enterprises to take part in the drafting of standards.
(3) Strengthening the construction of intellectual property data infrastructure. Optimize the functions of the National Intellectual Property Big Data Center, improve its basic architecture, strengthen data governance, and enhance monitoring, early-warning and security protection capabilities, so as to build it into the infrastructure hub for national intellectual property data resources. Support localities with the requisite conditions in building infrastructure such as regional intellectual property data centers, open up two-way secure data flow channels between the central and local levels, and achieve integrated linkage and coordinated operation. Encourage localities to build trusted data spaces for intellectual property and to connect them to the national data infrastructure system, so as to create a secure and mutually trusted environment for multi-source data and promote the cross-field, cross-departmental and cross-level sharing and use of intellectual property data.
(4) Advancing the application of new technologies such as artificial intelligence. Steadily advance the application of new technologies such as artificial intelligence, big data, cloud computing and blockchain, and carry out the development, training and deployment of industry-specific large models in an orderly manner. Encourage localities to explore the construction of public-service agents for different application scenarios and to develop convenient intelligent service tools, so as to raise the level of intelligence in the development and utilization of intellectual property data resources. Steadily advance the construction of high-quality intellectual property datasets, continuously enrich and promote such datasets, and encourage the registration and certification of catalogues of high-quality intellectual property datasets in the national dataset management and service system. Strengthen research on, and prevention of, security risks in artificial intelligence applications.
III. Expanding the supply of intellectual property data resources
(5) Advancing the sharing of intellectual property data. Implement the national requirements for government data sharing, adhere to a combination of proactive sharing and sharing on demand, continuously increase the categories of intellectual property data available for sharing, incorporate them into the national government data catalogue, and promote the principle of “one datum, one source” for intellectual property government data. Local authorities shall establish cross-departmental data-sharing mechanisms and gradually achieve interconnection between intellectual property data and data on science and technology, finance and market regulation, so as to promote data sharing and integration.
(6) Promoting the opening of intellectual property data. Continuously broaden the channels for opening data resources, optimize the means of opening, and make data easier to obtain. Upgrade the National Intellectual Property Public Service Platform to meet the basic data service needs of innovators and the general public for enquiry, search, access and use. Local authorities shall step up the promotion and popularization of intellectual property data user manuals and guides to the analysis and use of intellectual property information, and guide innovators in using intellectual property data resources in a compliant and efficient manner.
(7) Exploring the authorized operation of public intellectual property data. The China National Intellectual Property Administration shall strengthen the overall management of the authorized operation of public intellectual property data, improve the authorized operation mechanism, raise the level of standardization of authorized operation, and, together with the National Data Administration, guide localities in carrying out the authorized operation of public intellectual property data in a secure and orderly manner, select operating institutions on merit, and strengthen supervision of their operations, so as to provide professional services for the in-depth processing, distinctive development and market-based application of data.
IV. Deepening the application of intellectual property data resources
(8) Supporting government decision-making. Make comprehensive use of multi-source data on intellectual property, science and technology, industry and market regulation to carry out assessments of regional innovation capability, patent navigation for key industries and the like, thereby providing a basis for the formulation of industrial policies and the cultivation of high-quality innovators. Strengthen the statistical analysis of data on intellectual property pledges, licensing and assignment, and optimize the intellectual property operation and management mechanism. Strengthen the correlation analysis of data on patent applications, trademark registrations and credit supervision, screen for anomalies in breach of the principle of good faith and for leads on illegal agency practice, and promote regular and long-term supervision of the intellectual property agency industry. Promote the interconnection of intellectual property data with judicial adjudication and administrative enforcement data, so as to improve the effectiveness of coordinated intellectual property protection.
(9) Optimizing information services. Deepen “one-network processing” and “cross-provincial processing” of intellectual property business, and enable more matters to be handled through “one efficient transaction.” Strengthen the aggregation of intellectual property data and build databases such as industrial patent pool databases, patent databases for key industries, standard-essential patent databases, thematic databases for geographical indications and databases of overseas litigation cases, so as to provide more high-quality intellectual property information resources. Promote the integrated application of intellectual property data with judicial, scientific and technological, financial and market regulation data, and support the implementation of financial services such as intellectual property pledge financing, securitization and insurance. Support services such as analysis of the market prospects of patents, identification of enterprise needs and precise information delivery, so as to promote efficient matching of supply and demand in patent commercialization and use.
(10) Empowering enterprise innovation. Embed the use of intellectual property data deeply into the entire process of enterprise research and development, transformation of results, and enforcement and protection of rights. Strengthen technology life-cycle analysis, track patent developments in real time, identify technological gaps, and scientifically determine research and development directions. Strengthen the analysis of key patented technologies, draw on existing solutions, scientifically determine research and development paths, and support breakthroughs in core technologies. Strengthen research on portfolio strategies, support pre-filing assessment of intellectual property and freedom-to-operate analysis of patents, reasonably lay out high-value patents, and promote the transformation of technological results. Strengthen patent early-warning analysis, carry out risk assessment and monitoring of infringement, effectively identify and prevent risks, and genuinely safeguard the lawful rights and interests of enterprises.
V. Strengthening organization and implementation
The China National Intellectual Property Administration shall provide overall coordination for the nationwide work on the development and utilization of intellectual property data resources and, together with the National Data Administration, strengthen policy guidance, support and encourage localities to pilot initiatives in light of local conditions, and summarize and promote successful practices. Provincial intellectual property offices shall implement their territorial management responsibilities and incorporate the development and utilization of intellectual property data resources into the key work of intellectual property public services; provincial data administration departments shall strengthen guidance on the development and utilization of intellectual property data resources within their jurisdictions and support important work such as the construction of “data in motion” demonstration scenarios for public data in the intellectual property field and the construction of high-quality datasets. Intellectual property administration departments and data administration departments at all levels shall strengthen coordination and linkage and work together to fully release the value of intellectual property data resources.
