26 August 2026, Chișinău – The State Agency on Intellectual Property (AGEPI) is continuing the procedures necessary for designating the collector of remuneration for rights subject to mandatory collective management or to extended collective management. In parallel, the collective management organisations will be able to submit proposals for improving the legislative framework governing this field.

The next steps were discussed at a working meeting organised at AGEPI's initiative, with the participation of representatives of the authorised collective management organisations and of the joint collection structure, of the Ministry of Justice and of the Agency.

“The designation of the collector is a priority for AGEPI. We have the responsibility to carry this procedure through to the end in a transparent, equitable and legally well-founded manner, so that the collection mechanism works in the interest of authors and of all rights holders,” stated Natalia Mogol, Acting Director General of AGEPI.

The participants analysed the current state of the designation procedure, including the administrative stages completed in recent months and the legal situation of the organisations that may take part in this process. At present, the designation procedure is suspended in connection with a control procedure that is under way. AGEPI is to complete the stage that gave rise to this suspension, so that the designation procedure can continue.

The course of the process has also been influenced by the related administrative and judicial proceedings that arose in the course of the examination of certain AGEPI decisions. These required going through the stages provided for by law before a final decision could be adopted. AGEPI is ready to move the procedure forward, and compliance with the deadlines and fulfilment of the procedural obligations by all parties involved are important in order to avoid delays.

During the discussions, the representatives of the collective management organisations also flagged challenges in applying the current provisions of Law No. 230/2022 on copyright and related rights, including as regards the functioning of the collective management mechanism and the collection of remuneration. The parties agreed on the need to examine these issues and to formulate legislative solutions.

The representatives of the Ministry of Justice present at the meeting informed the participants that the process of amending Law No. 230/2022 is already under way, both to improve the collective management system and to continue harmonising the legislation of the Republic of Moldova with the acquis of the European Union. The collective management organisations and other interested parties are encouraged to contribute concrete proposals drawn from their experience in applying the law.

AGEPI emphasises that the designation of the collector entails verifying the capacity of the organisation that will administer the collection of remuneration, including its capacity to ensure a transparent mechanism of collection and distribution. Completing these verifications is necessary so that the decision adopted is lawful, well-founded and offers real guarantees to rights holders.
