To the intellectual property offices of all provinces, autonomous regions, municipalities directly under the Central Government and the Xinjiang Production and Construction Corps:

To thoroughly implement the decisions and deployments of the CPC Central Committee and the State Council, improve the IP public service system, raise the level of public services, and better support scientific and technological innovation and industrial upgrading, the following opinions are put forward in accordance with the Outline for Building an Intellectual Property Power (2021–2035) and the 15th Five-Year Plan for IP Protection and Utilization.

I. Overall Requirements

Adhere to Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era as guidance, thoroughly implement the spirit of the 20th CPC National Congress and successive plenary sessions of the 20th Central Committee, earnestly implement the deployments of the Fourth Plenary Session, fully and accurately implement the new development philosophy, take improving the IP public service system as the main line, and take optimising service supply, enhancing service capacity and raising service quality and efficiency as goals. By consolidating basic inclusive services, refining key services, building a collaborative service ecosystem and strengthening digital-intelligence empowerment, comprehensively raise the level of IP public services to provide strong support for scientific and technological innovation and industrial upgrading. By 2030, the IP public service system will be more sound and complete, IP public services more precise and effective, their role in promoting innovative development fully demonstrated, satisfaction of innovators and the public continuously raised, and IP innovation outcomes better empower development and benefit the people.

II. Promote Optimisation and Upgrading of Basic IP Services

Focus on the needs of innovators and the public, make basic services solid and detailed, and promote IP public services that are standardised, efficient, inclusive and accessible. (1) Strengthen standardisation of public services. Implement national standards for IP information public services, unify service content, processes and requirements, and raise standardisation. Strengthen graded and classified management of IP public service institutions, promote standardised and efficient operation, and concentrate on cultivating a batch of benchmark high-quality service institutions to promote professionalisation and distinctive development. (2) Expand the reach of basic services. Push public service supply to the innovation front line, support establishing IP public service workstations in industrial parks and innovation clusters, integrate service resources, and provide “one-stop” and “custody-style” services for innovators. Encourage universities to offer IP skills courses to enhance students’, teachers’ and researchers’ capacity to analyse and use IP information. (3) Strengthen matching of supply and demand for SME services. Deepen IP public service actions to assist enterprises, comprehensively collect service needs around SME development stages, technology levels and industrial-chain roles, and provide tailored services such as patent information analysis, industry navigation, commercialisation and use, infringement early warning and rights-enforcement assistance, promoting specialised and sophisticated SME development.

III. Promote Precise and Efficient Key IP Services

Around key core technology breakthroughs and industrial innovation needs, vigorously develop specialised and precise services and push IP public services toward the high end of the value chain. (4) Strengthen public services supporting sci-tech innovation. Establish “accompanying” service mechanisms for strategic sci-tech forces, providing IP information services throughout R&D, patent layout, commercialisation and rights protection to support key core technology breakthroughs. Improve IP management service norms for sci-tech breakthroughs, promote sound IP management systems in enterprises and research institutions mastering key core technologies, and comprehensively use patent layout, trade secret protection and other means to safeguard innovation and achievement transformation. (5) Strengthen public services promoting industrial innovation. Focusing on strategic emerging industries, conduct full industrial-chain patent navigation, sort out core patent distribution and technology barriers, cultivate high-value patents, and support precise R&D and risk prevention. Focusing on future industries, conduct customised frontier patent navigation, map technology evolution, competition patterns and patent blanks, and lay out high-value patents in advance. (6) Advance public services for innovation clusters. Establish joint service mechanisms around international sci-tech innovation centres, comprehensive national science centres, regional sci-tech innovation centres and national independent innovation demonstration zones, integrate information, legal, consulting and operations resources, and provide comprehensive services. Strengthen regional brand-building services and raise trademark brand value of industrial clusters.

IV. Build a Collaborative IP Service Ecosystem

Strengthen inter-ministerial coordination, central–local collaboration and regional cooperation, promote coordinated development of public and market-oriented services, and build a service pattern of government guidance, plural participation and efficient collaboration. (7) Strengthen cross-field collaborative services. Reinforce policy coordination with education, science and technology, industry and information technology and other departments; in major sci-tech innovation and key equipment projects, analyse patent technology trends and IP infringement risks, and formulate strategies for coordinated patent and trade-secret protection and layered layout of core and peripheral patents. Promote pre-filing patent assessment services for universities and research institutions. (8) Promote coordinated development of cross-regional services. Optimise public service network layout around regional coordinated development strategies and major regional strategies, and establish mechanisms for co-building and sharing cross-regional service resources. Advance integrated linkage of IP public services in the Beijing–Tianjin–Hebei region, the Yangtze River Delta, the Guangdong–Hong Kong–Macao Greater Bay Area and elsewhere. Deepen east–central–west collaboration and extend resources to weaker regions. (9) Promote coordinated development of public and market-oriented services. Unblock linkage channels, grow IP producer services, improve functional layout of IP service industry agglomeration zones, guide formation of IP service alliances, and support professional service institutions in participating in international exchanges and raising cross-border professional service capacity.

V. Strengthen Digital-Intelligence Empowerment of IP Public Services

Fully tap the value of IP data elements, deepen “AI+” applications, and raise the digital-intelligence level of IP public services. (10) Raise the level of development and utilisation of IP data resources. Establish cross-department, cross-level IP data collaborative governance mechanisms, improve management systems and standards, and firmly uphold data security. Expand the depth and breadth of IP data sharing and openness, and build high-quality IP datasets. Improve data infrastructure, optimise the National IP Big Data Centre, reasonably lay out regional data centres, and advance fusion applications of IP with judicial, financial, sci-tech, market regulation and other multi-source data. (11) Improve functions of IP public service platforms. Achieve unified identity authentication for IP business, build more online functions for rights protection, commercialisation and comprehensive management, and create dedicated service spaces for innovators. Advance mutual recognition of rules and information interoperability between the national IP public service platform and departmental and local platforms. (12) Strengthen application of AI technology. Actively apply AI around IP information analysis, examination and adjudication, commercialisation, risk early warning and comprehensive management. Enrich “AI+” information services and build intelligent application scenarios for patent navigation, value assessment, industrialisation analysis, supply–demand matching and infringement early-warning analysis. Encourage development of intelligent retrieval, analysis and Q&A tools and explore building intelligent agents.

VI. Strengthen Organisation and Implementation

CNIPA will strengthen overall planning and guidance, increase policy support, timely summarise and promote typical experience, and ensure solid advancement of all deployments. Provincial IP authorities shall refine implementation plans in light of local conditions, innovate service measures according to local circumstances, actively take the lead in trying first, create precise and effective service scenarios, and ensure all tasks are fully implemented.
