Establishing a long-term data-sharing and application cooperation mechanism

The China National Intellectual Property Administration (CNIPA) and the General Administration of Customs of China recently issued the Opinions on Strengthening Coordinated Intellectual Property Protection. The Opinions call for establishing a long-term data-sharing and application cooperation mechanism on the basis of safeguarding data security. CNIPA will regularly provide Customs with basic trademark, patent and other data to facilitate right holders’ Customs recordation; and will share information on confirmed well-known trademarks, trademarks revoked or declared invalid, and major patent infringement administrative adjudication decisions to support Customs enforcement.

On investigation assistance, the Opinions state that where IP authorities handling trademark or patent infringement cases involving import/export goods request Customs assistance, Customs shall assist; and where Customs investigating detained suspected infringing goods request IP authorities’ assistance, IP authorities shall assist.

On key-area protection, the Opinions require IP authorities to encourage right holders with well-known trademark confirmation records, collective/certification marks registered as geographical indications, and enterprises in key industries such as photovoltaics to actively apply for Customs IP recordation.
