To streamline and standardize the procedures for recording the transfer of ownership and changes to patent holder data, the BPTO has issued Ordinance No. 20, introducing the following changes:

  1. Exemption from notarization and legalization/apostille for digitally signed foreign documents (specific certifications will still be defined).

  2. No requirement for sworn translations of foreign-language documents.

  3. No witness signatures required.

  4. ICP-Brasil digital signatures on supporting documents for Brazilian applicants/patent holders.

  5. Proof of authority for assignor/assignee representatives.

  6. Declaration of address change by the owner or representative.


The ordinance takes effect on October 13, 2024.
