To streamline and standardize the procedures for recording the transfer of ownership and changes to patent holder data, the BPTO has issued Ordinance No. 20, introducing the following changes:
Exemption from notarization and legalization/apostille for digitally signed foreign documents (specific certifications will still be defined).
No requirement for sworn translations of foreign-language documents.
No witness signatures required.
ICP-Brasil digital signatures on supporting documents for Brazilian applicants/patent holders.
Proof of authority for assignor/assignee representatives.
Declaration of address change by the owner or representative.
The ordinance takes effect on October 13, 2024.
