Proposed Trademark Fees Changes For Fisc

The USPTO is proposing certain trademark fee adjustments. These are only PROPOSALS. When the USPTO makes their final decision, we will let you know. As set forth in the notice of proposed rulemaking, some of the proposed fee adjustments include:

  1. Elimination of TEAS PLUS and TEAS STANDARD applications, being replaced by a single electronic filing option.

  2. Filing surcharge fees for informal applications, i.e. insufficient information, using the free text field for the goods as opposed to selecting from the Trademark Next Generation ID Manual (ID Manual), and each additional 1,000 characters beyond the 1,000 per class fee.

  3. Increasing Amendment to Allege Use and Statement of Use fees.

  4. Increasing Post-Registration Maintenance Fees.

  5. Increasing Letter of Protest Fee

  6. Other Petition Fees to increase including Petition to the Director and Petition to Revive.

This change is for the 2025 fiscal year which begins on October 1, 2024, but the implementation date has not yet been determined. Again, when a final decision is made, more information will be forthcoming.
